RELATED TO CUSTOMER PRODUCT PURCHASES VIA THE INTERNET
TO CUSTOMER: IN ORDER TO PURCHASE AND LICENSE THE PRODUCTS WHICH MAKE UP THE DIGITAL PEN AND PAPER SYSTEM, YOU MUST ACKNOWLEDGE THAT YOU HAVE READ AND ACCEPT WITH THE FOLLOWING POLICIES AND INFORMATION BY CLICKING ON THE ACCEPT BUTTON AT THE END OF THIS PAGE.
1. Security of Credit Card Transaction Payment Data
All Customer credit card payment data entered when Customer places a Purchase Order for any Products offered by DigitalWriting Systems™ ("DWS") is encrypted by DWS through the use of a Secure Socket Layer ("SSL").
2. Replacement and Refund Policies.
The DWS policies for return and replacement of defective Digital Pens and Digital Paper are set forth in the DWS On-Line Customer Purchase, Use and License Agreement and in the DWS issued Digital Pen Insurance Certificate, if Customer has purchased Digital Pen Insurance from DWS. However, if DWS is unable to deliver any Products within sixty (60) days of the date Customer places a Purchase Order for such Products, DWS will cancel the Purchase Order and make a full refund of all fees or other monies Customer has paid for such Products.
3. Product Pricing in United States Dollars.
All Products offered by DWS through the DWS Website and the DWS On-line Customer Purchase, Use and License Agreement are offered in United States Dollars only.
4. Shipping Policies.
Unless otherwise specified by Customer, DWS will ship all Products that require shipping by United Parcel Service ("UPS").
5. Privacy Policy.
(a) General Policy. DigitalWriting Systems is highly sensitive to the privacy interests of its Customers and believes that the protection of those interests is one of its most significant responsibilities. In acknowledgment of its obligations, DigitalWriting Systems has adopted the following Privacy Policy applicable to information about Customers that it acquires in the course of its business:
(b) Acquisition of Information. We do not acquire any more information about Customers than is required by law or is otherwise necessary to provide a high level of service efficiently and securely.
(c) Our Employees and Privacy. We train all of our employees about the importance of privacy. We give access to information about Customers only to those employees who require it to perform their jobs.
(d) Security Measures. We make access to privacy-sensitive information subject to controls, consistent with legal requirements and the demands of customer service.
(e) Disclosure to Third Parties. We will provide individually-identifiable information about Customers to third parties only if we are compelled to do so by order of a duly-empowered governmental authority, we have the express permission of the Customer, or it is necessary to process transactions and provide our services.
(f) Privacy and Our Business Partners. When we make our technology or services available to business partners, we will not share with them any more Customer information than is necessary and we will make every reasonable effort to assure, by contract or otherwise, that they use our technology and services in a manner that is consistent with this Privacy Policy, including Paragraph 5(e).
